HOUSE RULES

RSVP to all classes. This allows our staff to prepare so that we can provide you quality instruction and attention.

Be early.  If you’re not early, you’re late. Give yourself enough time to change, pre-warmup, and put your stuff away before class starts.

No DOUBLE DIPPING. one muscle thru session a day is rule. studies have shown that there is no benefit to doing our style of workout back to back or multiple times in one day. when you show up to workout, empty the tank in that one session.

Fitness education is our intent. Pay attention in classes, ask pertinent questions, and don’t disrupt the class for your fellow classmates. Follow our blog for workouts and other information. Leave your ego at the door. Don’t drag people down with a bad attitude. Be optimistic, have fun and push yourself and those around you to do better.

Respect our equipment. These are the tools that will make you healthy and strong. Treat them with respect and they will pay it back with fitness! NEVER drop a plate, kettlebell, or dumbbell unless your physical safety is in danger. Clean up.  Put away your toys.

Show up, have fun & work hard. The reason we continue to put ourselves through all of this hard work is because it’s worth it. We work hard, but we have a lot of fun doing it.

Take ownership. This is your gym. Help us continue the evolution of the facility. If you see something, say something. Whether it’s someone lifting with a rounded back, if we’re running low on toilet paper, if we need more pens for the journals, or if you just set a PR, please let us know!

If you are: Racist, Sexist, Homophobic, or an A**hole… you are not welcome here and we reserve the right to show you the door.

TERMS AND CONDITIONS FOR MUSCLE THRU GYM.

Your “Assigned Commitment” is the monthly commitment, training package, punch card, seminar, course, or any other plan or pass you have signed up for. By purchasing an Assigned Commitment, you understand that you have chosen to enter into a legally enforceable agreement with MUSCLE THRU and be bound the terms and conditions as presented in this document.Your Assigned Commitment is good for the duration that the membership is active. This membership is only good at MUSCLE THRU, 832 Dacula Road #101, Dacula, GA 30019.You agree to pay the “price per period” at the “billing period” frequency for the “membership” access at the “Assigned Commitment” quantity all listed at the bottom of this page unless you cancel your Assigned Commitment according to the Cancellation Policy included below. Your Assigned Commitment allows you to participate in the Assigned Commitment’s classes or courses offered at MUSCLE THRU. It does not grant you access to any class, seminar or specialty class outside the scope of this Assigned Commitment that MUSCLE THRU may offer.If, after you agree to your Assigned Commitment, you wish to increase your commitment to a higher tier (for example, moving from CHOICE - 12 sessions per month to PREMIER - unlimited (one session per each day of operation) monthly, you may do so. An upgraded monthly commitment continues through the end of the current upgraded month and will be automatically renewed at the upgraded monthly membership.MUSCLE THRU operates by class/session or appointment-only training, unless otherwise noted. MUSCLE THRU may alter its location, operating hours, services, type and quantity of equipment, and type and frequency of its classes, from time to time, at its sole discretion. Fitness training is an evolving science, thus MUSCLE THRU reserves the right to change its routines, classes and equipment, policies and procedures, memberships, fees, rates, to accommodate such evolution.MUSCLE THRU reserves the right to adjust membership rates as needed inside the life of your Assigned Commitment to maintain the financial health of the business, to cover increases in business expenses (rent, staffing, etc.), and/or to improve the product provided to the member/s. A minimum of 14 days will be given for any pricing changes. In the event that MUSCLE THRU elects to adjust the membership rates, you may cancel your continued membership by submitting a written email cancellation 7 days before your next billing date.There are no refunds for membership fees. MUSCLE THRU will not prorate a cancelled membership. Unused portions of any membership will not be carried over to the next period.The obligation to pay dues is not dependent on the availability of all the MUSCLE THRU classes and facilities. MUSCLE THRU may close or restrict use of its facilities, in its sole and absolute discretion, for any reason including, but not limited to, special engagements, seminars, competitions, weather, repairs, and maintenance. Fees will not be reduced or suspended during the time when one or more of the facilities are not available.We reserve the right to refuse service to anyone for any reason. We reserve the right to cancel a membership at any time for any reason.

PAYMENT OPTIONS AND AUTOMATIC RENEWAL.

You agree that your payments will be made by credit card. You further agree that, unless you have provided MUSCLE THRU with prior written notice according to the cancellation policies below, your enrollment options will be automatically renewed. In the absence of providing MUSCLE THRU with a Cancellation Notice, you agree to pay the applicable fee and authorize MUSCLE THRU to debit your credit or debit card, in accordance with your prior authorization.After your Assigned Commitment is complete, your membership will auto-renew with a new commitment of the same type and duration on the same billing day of each month (For example, if a member’s initial Agreed Commitment is for unlimited package, and your first billing date was on the the 9th of the first month of your assigned commitment, you will automatically be signed up on the 9th of the subsequent month for the same membership package you were currently assigned.Should you choose to cancel your membership, you must notify MUSCLE THRU by cancellation form on msclthru.com/membership-cancellation 30 days before your Assigned Commitment renewal date (For example, if you signed up for a membership on the 11th, you must cancel 30 days before the 11th of the upcoming month to prevent auto-renewal).

MUSCLE THRU MEMBERSHIP HOLD POLICY.

You must request that your membership be placed on hold for circumstances such as injury, illness, work-required travel, and job loss. MUSCLE THRU does not hold memberships for less than 30 days. Holds must be submitted via online pause form. There is an $30 hold fee to account for every 30 days the hold is in effect. You will receive a confirmation once your hold is approved. After the hold is completed, the membership will restore to active status, and automatic billing will restore to active status as well.Membership holds will be granted at the sole discretion of MUSCLE THRU.Placing your membership on hold means that you will not have access to MUSCLE THRU for the duration of the hold. Your Assigned Commitment will be suspended for the duration of the hold and will resume when the hold terminates. (For example, a member with a monthly Assigned Commitment asks for and is granted a 30-day membership hold. When the hold terminates, the member will have the days extended into the returning month membership, and that returning month of membership will be prorated accordingly.)

MUSCLE THRU CANCELLATION POLICY.


You must cancel the automatically renewal of your Assigned Commitment by notifying MUSCLE THRU by the caNCElation form via msclthru.com/membership-pause at least 15 days before your next billing payment is scheduled renew. If you cancel your Assigned Commitment for any reason, you lose all rights and benefits associated with your Assigned Commitment. If you decide to return in the future, the price of your monthly membership rates will be maintained for a period of 2 months. After a period of 2 months, your eligibility for legacy pricing expires.There are no refunds for membership fees MUSCLE THRU will not prorate a cancelled membership. All non-standard requests will be charged a $30 fee for processing.BILLING INFORMATION AND FAILED PAYMENTS If your billing information is becoming or becomes invalid (for example, your credit card is expiring or you cancel the card number you entered initially), you must promptly update your billing information in the online customer management software app at least five days before your next billing date.If the billing information (for example, credit card number) you entered is incorrect or becomes incorrect and your monthly payment fails, MUSCLE THRU will notify you of such failure by e-mail. If you do not correct your billing information within ten calendar days of the e-mailed notice, we reserve the right to charge you $30 for the first failed monthly payment. You will be charged $30 for each failed monthly payment after your first notice of a failed monthly payment. You will remain liable for your monthly membership payment in addition to these fees.

NOTICE FOR COLLECTIONS.

MUSCLE THRU reserves the right to send any membership, commitment, fees, or any contracted purchase to collections if the account is 30 days past due. MUSCLE THRU will contact the member at least once via phone, and or e-mail to resolve the payment issue. If the member does not promptly pay the amount owed, the total amount due for the member’s remaining Assigned Commitment plus any additional fees may be sent to a collection agency for collection. If such action is necessary, you agree to pay all costs incurred by MUSCLE THRU for collection, including reasonable attorneys’ fees.
TO OUR INDIVIDUAL CLIENTS Your privacy is important to us, and maintaining your trust and confidence is one of our highest priorities. We respect your right to keep your personal information confidential and understand your desire to avoid unwanted solicitations. Providing personal information is an act of trust and it is taken seriously. Unless given consent to do otherwise, Muscle Thru will only collect and use personal information as set out below. We are disclosing this policy to you so that you will have a better understanding of what we do with the information you provide us and how we keep it private and secure. Except as otherwise described in this notice, we restrict access to nonpublic personal information about you to employees of our gym who must use that information to provide services to you. Thank you for allowing us to serve all your fitness needs. We value your business and are committed to protecting your privacy. Please call us if you have any questions or if we can be of further service.

A. TYPES OF INFORMATION WE COLLECT We collect certain personal and billing information about you, only when that information is provided by you or is obtained by us with your authorization. We use that information solely for the purposes of setting up your account in our business management software which collects scheduled payments and for merchandising. This information is mandatory to set up an account with our facility and will be used only to create your Muscle Thru membership. As a general rule, we do not disclose personal information about our clients or former clients to anyone for any reason without your consent or authorization.

B. USING AND DISCLOSING YOUR PERSONAL INFORMATION Personal Information will be used for the following primary purpose:
• To fulfill obligations under your membership agreement and/or any other contract between you and Muscle Thru.
• To render services under your membership agreement.
• To provide information about products, service and/or special offers.
• To obtain opinions or comments about products and/or services.
• To record statistical data for marketing analysis.
Muscle Thru may employ other companies or individuals to assist us in providing our services, or to provide certain services such as providing marketing assistance or consulting services. These third parties may have access to information needed to perform their function but cannot use that information for other purposes.

SERVICE PROVIDERS We use third party business management software to bill you for services and an email service provider to send out emails on our behalf. We use discussion board and forum software to give you an opportunity to communicate with other members while using our site. You will always be asked to sign-up for any of our third party software and we do not give your information to them for any reason.

ACCESS TO PERSONAL INFORMATION If your collected information changes, you may correct or update via the Muscle Thru app. If you no longer desire our service, you are able to process your membership cancellation via MEMBERSHIP CANCELLATION

STORAGE AND SECURITY OF PERSONAL INFORMATION Muscle Thru will take all reasonable steps to keep secure any personal information recorded, and to keep this information accurate and up to date. The information is stored on secure servers if in digital format, or in locked areas if in hardcopy format. Muscle Thru employees are obliged to respect the confidentiality of any personal information. However, security of communications over the Internet cannot be guaranteed, and therefore absolute assurance that information will be secure at all times cannot be given. Muscle Thru will not be held responsible for events arising from unauthorized access to personal information.

MUSCLE THRU AND LINKS TO OTHER WEBSITES Muscle Thru may provide links to websites outside of the Muscle Thru site. These linked sites are not under the control of Muscle Thru, and Muscle Thru is not responsible for the conduct of companies linked to the Muscle Thru website, nor for the performance or otherwise of any content and/or software contained in such external websites.
